Grant of License: In consideration of payment as described herein, JEFF W. BURNHAM ARCHITECT ("JWB") hereby licenses "YOU" (or "YOUR" if the context requires) to use the construction documents supplied by JWB to construct one structure, as depicted in the construction documents, one time, on one site. This is a non-exclusive license. The license also grants YOU the right to modify the plan to meet specific site, zoning, code or other design needs. JWB hereby reserves all rights not expressly granted in this license. This license is non-transferable and does not allow YOU to post the construction documents on the internet, resell them or use the design more than once. NO REFUNDS are available once payment has been made for the license.
The construction documents subject to the foregoing license are instruments of JWB's services and JWB owns the copyright in them. YOU are licensed to make copies only as needed for permitting and construction of one structure, on one site, one time. Unauthorized copying of the construction documents is prohibited by law and JWB shall be entitled to pursue legal remedies and damages under the US Copyright Law.
An email containing a multi-page PDF of the construction documents will be sent to YOU within two (2) business days of JWB's receipt of payment.
This transaction is for the grant of a license to use copyrighted documents which are provided on an "AS IS" basis. It is NOT a sale of a product and there are no warranties, either express or implied. TO THE FULLEST EXTENT ALLOWED BY LAW, JWB DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND THE WARRANTY OF MERCHANTABILITY.
